By accessing or using the Website you agree to be bound by these Terms and Conditions (the “Conditions”) and our Privacy Policy.
I. GENERAL TERMS OF USE
- Acceptance & Updates – Your continued use of the Website constitutes acceptance of the Conditions as amended from time to time. Review them regularly; if you disagree with any change, cease using the Website.
- Registration & Account Security
a. You may browse most content without registration. To place orders or access certain features you must create an account via the “Log In” page.
b. You warrant that all information provided is accurate, current and complete, and that you will promptly update it when it changes.
c. You are responsible for maintaining the confidentiality of your login credentials and for all activities that occur under your account, whether or not authorised by you. Notify us immediately of unauthorised use. - Website Availability & Modifications – We may modify, suspend or withdraw the Website (in whole or part) without notice. We shall not be liable for any resulting unavailability.
- Acceptable Use – You agree to use the Website lawfully and ethically. You must not:
• attempt unauthorised access to any part of the Website;
• interfere with its security, integrity or performance;
• use it to transmit unlawful, harmful or infringing material.

- Limitation of Liability – To the fullest extent permitted by law, we shall not be liable for any indirect, incidental or consequential loss arising from your use of the Website. Nothing in these Conditions limits liability for death or personal injury resulting from our negligence or for fraud.
- Age Restrictions – You must be at least 16 years old to register an account. By placing an order you confirm that you are at least 18 years old or have the consent of a parent or legal guardian, who accepts responsibility for your actions.
- Security & Third‑Party Links – We cannot guarantee the Website is free from viruses or security breaches. Use suitable protection. Links to third‑party sites are provided for convenience; we have no control over, and accept no liability for, their content or availability.
II. SALE OF PHYSICAL PRODUCTS
A. Order Process & Contract Formation
- By placing an order you warrant that:
• you are legally capable of entering into binding contracts;
• all information supplied is correct and complete. - After checkout you will receive an order‑confirmation e‑mail. A contract is formed only when the products are dispatched; we reserve the right to decline or cancel an order prior to dispatch for any reason (including stock unavailability, payment issues or suspected fraud).
B. Dispatch & Cancellation
- Cancellation Window – Orders may be cancelled only until the moment they are handed over to our carrier. Once a tracking number has been generated or the parcel collected, the order is deemed dispatched and cannot be cancelled.
- Post‑Dispatch Options – If you no longer wish to receive the goods after dispatch you may:
• refuse delivery, or
• accept delivery and exercise your right of withdrawal (Section E) by returning the goods within 14 days.

Written confirmation of cancellation will be provided if accepted.
C. Shipping Options
- Available delivery services, costs, and estimated transit times are displayed at checkout. Transit times are estimates provided by the carrier and are not guaranteed.
- Orders placed after 17:00 CET are processed the next business day.
- Pricing errors: In rare cases a pricing or free‑shipping display may occur because of a technical fault. Such displays are non‑binding until the order is verified prior to dispatch. If the correct shipping cost differs, the customer will be offered the choice to pay the correct cost or to cancel for a full refund.
D. Customs, Duties & Import Fees
- Products shipped outside the European Union may be subject to taxes, customs duties and fees (“Import Fees”) levied by the destination country. The recipient is the importer of record and responsible for all Import Fees.
- Failure to Clear Customs – If a shipment is returned to Yoyaku because the customer failed to clear customs or refused to pay Import Fees, the customer will be charged for all return‑shipping costs and any duties or taxes assessed. Refunds will be processed minus these costs.
- Customs policies vary; contact your local customs office for details. Customs procedures may add delays beyond our delivery estimates.
- Yoyaku will not refund or compensate orders held or confiscated by customs due to non‑payment of Import Fees.
E. Transit Delays Delays caused by the carrier, customs, weather, strikes, force majeure or any circumstance beyond Yoyaku’s reasonable control do not constitute grounds for cancellation or compensation. We will assist in opening an investigation with the carrier; refunds are issued only when the parcel is returned or formally declared lost.
F. Returns & Right of Withdrawal (EU)
- Right of Withdrawal – Under the EU Consumer Rights Directive you may withdraw from the purchase within 14 days of physical receipt of the goods. You must first obtain a Return Authorisation (RMA) by contacting [email protected].
- Goods must be returned unused, in their original condition and packaging, with proof of purchase, within 14 days of the RMA being issued.
- Costs & Refunds – Return shipping costs are borne by the customer. Refunds exclude the original outbound shipping charge and will be reduced by any return freight, customs or handling fees not already paid by the customer. Refunds are processed using the original payment method within 14 days of our receipt and inspection of the returned goods.
G. Damaged or Defective Goods
- Notify us within 7 calendar days of delivery, providing:
• clear photographs of the outer packaging, shipping label and damaged product;
• a detailed description of the issue. - Transport‑related damage claims require sufficient evidence and are subject to the carrier’s investigation and policies. Compensation applies only to damage affecting outer sleeves or packaging. Surface marks or pressing defects on vinyl records are manufacturing issues and are not covered.
- Opening a dispute via a third‑party platform (e.g. PayPal) before completing this process may delay or invalidate the claim.
III. PRIVACY
Your privacy is important to us. Personal data is processed in accordance with our Privacy Policy, available on the Website.
IV. FORCE MAJEURE
We shall not be liable for any failure or delay in performing our obligations where such failure or delay results from events beyond our reasonable control, including but not limited to carrier delays, customs actions, strikes, pandemics, natural disasters or governmental orders.
V. SEVERABILITY, ENTIRE AGREEMENT & WAIVER
If any provision of these Conditions is found invalid or unenforceable, the remaining provisions shall remain in full force. These Conditions and the Privacy Policy constitute the entire agreement between you and Yoyaku, superseding all prior understandings. No waiver of any breach shall be deemed a waiver of any subsequent breach.
VI. GOVERNING LAW & JURISDICTION
These Conditions are governed by French law. Any dispute arising out of or in connection with them shall be subject to the exclusive jurisdiction of the competent French courts, without prejudice to mandatory protective provisions that may apply in your country of residence.
